Terms & Conditions

Last updated: 11 October 2026

Who you are contracting with

These terms are between you and Neuro 369 Pty Ltd ("Neuro 369", "we", "us"), the seller and operator of this website and its digital tools, including the Pendulum app. By using our website or purchasing our products, you agree to these terms. If you do not agree, please do not use our services.

What we provide

Neuro 369 offers self-care and wellbeing tools, including Pendulum — a self-guided EMDR-style companion for emotional eating. Our digital tools are companions for self-care. They are not therapy, medical treatment, or a substitute for care from a qualified professional, and they do not create a practitioner–client relationship.

Acceptable use

You must not misuse our services. That includes:

  • Using the services for anything unlawful
  • Fraud, spam, or deceptive conduct
  • Infringing intellectual property rights
  • Interfering with the security or operation of the services — including introducing malware, probing or scanning systems, or scraping content
  • Reverse engineering, reselling, or redistributing our tools

Intellectual property

Neuro 369 Pty Ltd owns the services and all associated intellectual property, including software, documentation, design, and branding. When you purchase Pendulum, we grant you a limited, non-exclusive, non-transferable licence to use it for your personal, non-commercial self-care. This licence does not transfer any ownership to you.

Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, and related mechanics are governed by Paddle's Buyer Terms. Pendulum is sold as a one-time purchase with lifetime access — there is no subscription and nothing to cancel.

Refunds

Our refund terms are set out in our Refund Policy.

Service availability

We work hard to keep our services available, but we do not guarantee they will be uninterrupted or error-free. We may update, change, or withdraw features from time to time.

Suspension and termination

We may suspend or terminate your access to the services if you materially breach these terms, if payment is not made, if there is a security or fraud risk, or for repeated or serious violations of our policies.

Warranties and liability

To the fullest extent permitted by law, our services are provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill), and our aggregate liability is capped at the fees you paid us in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including for fraud, death, or personal injury, or your rights under Australian Consumer Law.

Governing law

These terms are governed by the laws of Tasmania, Australia, and the courts of Tasmania have exclusive jurisdiction, except where consumer law gives you the right to bring proceedings elsewhere.
